Terms of Use for Real Growth by Soluify™ LLC

Effective: January 1st, 2025

PLEASE READ THESE TERMS CAREFULLY BEFORE SUBSCRIBING OR ACCESSING THE REAL GROWTH PLATFORM. THESE TERMS OF USE (“AGREEMENT”) FORM A LEGALLY BINDING CONTRACT BETWEEN YOU (“YOU” OR “USER”) AND SOLUIFY™ LLC (“SOLUIFY,” “WE,” “US,” OR “OUR”), THE COMPANY THAT OWNS AND OPERATES THE REAL GROWTH COMMUNITY AND PLATFORM.

By accessing the Real Growth platform, purchasing a subscription, or otherwise engaging with our Services, you agree to comply with and be bound by this Agreement. If you do not agree to these Terms, you are prohibited from accessing or using our Services.

1. Purpose of Real Growth

Real Growth, a product of Soluify™ LLC, is a subscription-based platform designed for educational purposes, offering courses, interactive learning materials, and fostering personal and professional growth through an engaged community of Members.

By subscribing to Real Growth, you gain exclusive access to a curated learning ecosystem and a collaborative Member community.

2. Eligibility

By subscribing to Real Growth or accessing its features, you confirm that:

  • You are at least 18 years of age (or 13 with the consent of a parent or guardian).
  • You have the legal authority to enter this Agreement.
  • You agree to follow these Terms and comply with all applicable laws, rules, and regulations.

3. Subscription Access and Member Privileges

Access to Real Growth

When subscribing to Real Growth, you are granted a non-transferable, non-exclusive, revocable license to access and use Soluify™ LLC’s Services for your personal, non-commercial use during your active subscription.

Non-Transferability

  • Your subscription is personal to you. Sharing, transferring, or selling access to your account or any Service content is strictly prohibited.

Security Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorized use of your account, you must notify us immediately at support@soluify.com .

4. Acceptable Use Policy

To maintain a professional and positive community, you agree NOT to engage in the following prohibited activities:

Prohibited Activities

You must not:

  • Use the Real Growth platform for illegal, harmful, or deceptive purposes.
  • Harass, intimidate, or harm other Members of the community.
  • Share, reproduce, sell, or distribute any Real Growth content without prior authorization from Soluify™ LLC.
  • Use automated tools, bots, scrapers, or any unauthorized software to access or interact with the Services.
  • Interfere with the platform’s functionality, security measures, or servers.
  • Post content that is defamatory, obscene, offensive, or discriminatory.
  • Infringe upon the intellectual property or privacy rights of others.

Violations of this Acceptable Use Policy may result in content removal, temporary suspension, or permanent termination of your account, at Soluify™ LLC’s discretion.

5. Subscription Payments

Billing and Auto-Renewal

By subscribing to Real Growth, you agree to:

  • Provide accurate and complete payment information.
  • Authorize Soluify™ LLC (or its third-party payment processor) to charge your chosen payment method for subscription fees.
  • Consent to automatic renewal of your subscription at the end of your billing cycle unless canceled prior to the renewal date.

Fees are in U.S. dollars and are non-refundable, except where required by law.

Cancellation Policy

  • How to Cancel: You may cancel your subscription at any time via your account’s Billing Settings or by contacting us at billing@soluify.com .
  • Access After Cancellation: Upon cancellation, access to the Services will be revoked immediately. It is assumed that you have consumed all necessary content at the time of cancellation. Please ensure you have completed your courses or downloaded any permissible resources before canceling.
  • No Refunds: No refunds will be provided for any unused portion of a billing cycle unless required by applicable law.

6. Member Content and Community Rules

When submitting, posting, or sharing content within the Real Growth community (“User Content”), you:

  1. Grant Soluify™ LLC a non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute your User Content in connection with the Services.
  2. Warrant that your User Content:
    • Does not violate intellectual property rights or privacy laws.
    • Is truthful, lawful, and aligned with community standards of respect and integrity.
    • Does not include offensive, misleading, or fraudulent material.

We reserve the right to moderate, remove, or restrict any content that violates this Agreement or affects the experience of other Members negatively.

7. Intellectual Property Rights

All content provided on the Real Growth platform, including but not limited to courses, videos, text, images, graphics, and software (collectively, “Content”), is owned by or licensed to Soluify™ LLC. These materials are protected by copyright, trademark, and intellectual property laws.

You agree not to:

  • Copy, reproduce, distribute, or modify the Content without explicit authorization.
  • Remove or alter any proprietary notices or disclaimers on the Content.

8. Privacy Policy

Your use of the Services is subject to our Privacy Policy, which governs how we collect, use, and store your personal data. By subscribing, you agree to the Privacy Policy, which is incorporated by reference into this Agreement.

9. Refund Policy

While the majority of subscription fees are non-refundable, refund requests will be reviewed on a case-by-case basis subject to our sole discretion. In certain cases, refunds may be granted in compliance with applicable law.

10. Disclaimer of Warranties

The Real Growth platform and all related Services are provided “AS IS” and “AS AVAILABLE” . Soluify™ LLC makes no guarantees regarding:

  • The uninterrupted operation or error-free experience of the platform.
  • The accuracy, relevance, or reliability of educational content.
  • The absence of malware or harmful elements in system operations.

You access and use the Services at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • SOLUIFY™ LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT OR DATA.
  • THE TOTAL LIABILITY OF SOLUIFY™ LLC (INCLUDING ITS EMPLOYEES, AGENTS, AND AFFILIATES) FOR CLAIMS ARISING OUT OF YOUR USE OF THE SERVICES WILL NOT EXCEED THE AMOUNT YOU HAVE PAID FOR THE SERVICES IN THE LAST THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

12. Dispute Resolution and Arbitration Agreement

Mandatory Arbitration

All disputes, claims, or controversies arising from or related to your use of Real Growth or this Agreement will be resolved solely through binding arbitration. By agreeing to arbitration, you waive your right to a jury trial or participation in class actions.

Opt-Out Option

You may opt out of the arbitration provision within 30 days of your first subscription date by notifying us at legal@soluify.com with the subject line “Opt-Out.”

13. Termination of Services

Soluify™ LLC reserves the right to suspend or terminate your access to the Real Growth platform if you violate these Terms, fail to pay owed subscription fees, or engage in any misconduct that compromises the community’s integrity.

14. General Terms

  • Choice of Law: This Agreement is governed by the laws of [Your State] unless otherwise required by law.
  • Severability: If any part of this Agreement is found invalid, the remaining provisions shall remain enforceable.
  • Entire Agreement: These Terms (along with the Privacy Policy) form the entire Agreement between you and Soluify™ LLC with respect to the Services.
